Welcome to WaSend, a WhatsApp Marketing platform that helps businesses automate messaging, manage customers, and grow sales.
By accessing or using Wasend, you agree to be bound by these Terms of Use (“Terms”). Please read them carefully before using our service.
1. Acceptance of Terms
By creating an account, accessing, or using WaSend, you acknowledge that you have read, understood, and agree to comply with these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use the Service.
2. Description of the Service
WaSend is a cloud-based SaaS (Software-as-a-Service) platform that provides:
- WhatsApp bulk messaging (Broadcast);
- Automated message flows (Automation);
- Customer management and segmentation (CRM);
- Integration with Shopify and other platforms;
- Campaign analytics and performance reports.
WaSend is provided “as is” and may be modified, updated, or discontinued at any time without prior notice.
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account.
- You must notify WaSend immediately of any unauthorized access or use of your account.
- Each user may create multiple Workspaces, each with its own resources and users.
4. License and Acceptable Use
WaSend grants you a non-exclusive, non-transferable, limited license to use the Service for lawful business purposes.
You agree not to:
- Use WaSend for spam, fraud, or sending messages that violate Meta’s/WhatsApp’s Business Policy;
- Copy, modify, distribute, or resell the Service or any part of it;
- Interfere with or disrupt the platform, servers, or networks connected to WaSend.
WaSend reserves the right to suspend or terminate your account for any violation of these Terms.
5. Third-Party Integrations
WaSend is not owned or operated by Meta Platforms or WhatsApp Inc.
You must comply with WhatsApp Business and Commerce Policies when using the Service.
When you connect your WhatsApp, Shopify, or other third-party accounts, you grant WaSend permission to access and process data necessary to provide the requested features.
6. User Data and Content
- You retain ownership of all data, content, messages, and customer information you upload to WaSend.
- WaSend does not share your personal data with third parties except as required by law or with your explicit consent.
- WaSend may use aggregated and anonymized data for analytics and product improvement.
7. Payments and Subscription
- WaSend operates on a subscription basis (monthly or yearly).
- All pricing and billing terms are specified within your account or on our website.
- Failure to pay on time may result in suspension or termination of your account.
- All payments are non-refundable, except where explicitly stated otherwise in writing.
8. Limitation of Liability
WaSend and its affiliates shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities.
We do not guarantee uninterrupted, error-free, or fully compatible operation of the Service.
In any case, WaSend’s total liability shall not exceed the amount you paid for the Service within the last three (3) months.
9. Termination
You may cancel your account and stop using the Service at any time.
WaSend may suspend or terminate your access if:
- You violate these Terms;
- We are required to do so by law;
- We decide to discontinue the Service.
Upon termination, you remain responsible for all outstanding payments.
10. Intellectual Property
All source code, design, trademarks, logos, and documentation of WaSend are the exclusive property of TrustShop Company.
You may not reproduce, distribute, or use them for commercial purposes without written permission.
11. Governing Law
These Terms are governed by the laws of Vietnam.
Any dispute arising from or relating to the Service shall be resolved by the competent courts of Ho Chi Minh City, Vietnam, unless otherwise agreed in writing.
